Crafting an interim parenting time schedule

On Behalf of | Feb 12, 2025 | Family Law & Divorce

An interim parenting time schedule can help to provide structure and stability for both parents and children as a family transitions in the wake of a decision to separate or divorce. In Minnesota, courts generally encourage parents to create a temporary schedule that prioritizes a child’s best interests while simultaneously reflecting a need for both parents to maintain meaningful relationships with them.

An interim parenting schedule should reflect a child’s current routine as much as possible to minimize disruption. Factors such as school schedules, extracurricular activities and each parent’s work commitments should be considered when dividing time. If parents can communicate effectively, they may be able to create a temporary schedule through mutual agreement. In cases where conflict makes direct negotiation difficult, mediation can help parents find a workable arrangement without court intervention. Litigation is possible in cases when no other option is workable and/or appropriate.

Making a plan

Common interim parenting schedules include alternating weeks, midweek visits or dividing weekends based on availability. If one parent has historically been the primary caregiver, the schedule may initially reflect that role while allowing the other parent consistent time to bond with their child.

Because an interim parenting schedule is temporary, flexibility is generally a wise approach. Parents should be prepared to adjust the arrangement if unforeseen circumstances arise, such as changes in work schedules, unexpected travel or the child’s evolving needs. Open communication between parents can prevent misunderstandings and make transitions smoother for the child.

While many interim parenting schedules are created voluntarily, some situations require court approval. If parents cannot agree on a temporary schedule, either party can petition the court for a temporary custody order.

To that end, an interim parenting schedule is a stepping stone toward a final custody arrangement. Parents should document how well the schedule is working and whether any challenges arise. This information can help guide future discussions and legal proceedings regarding permanent parenting time arrangements.

A well-crafted interim schedule can minimize stress for both parents and children, providing a stable framework during a period of change. By focusing on cooperation and a child’s well-being, parents can make the transition smoother while laying the groundwork for a long-term parenting plan that serves everyone’s best interests.
